Terms and conditions
1. DEFINITION AND OBJECT OF THE CONTRACT
1.1 - This contract ("Contract") is a distance contract, pursuant to art. 50 and ss. Of Legislative Decree 6 September 2005, no. 206 ("Consumption Code") and Legislative Decree 206/05, implementing Directive 97/7 / EC on the protection of consumers in respect of distance contracts. The contract deals with the sale of movable property between Milan srl Via Cesare 7, 94012 Barrafranca, and the consumer ("Customer"). The Contract is concluded directly through the acceptance of a proposed purchase by the Customer by telephone, fax, e-mail or via the internet on the website "ilcontadinodisicilia.com" (the "Site") Based on the procedures described in the following Article 3.
1.2 - These general terms of sale ("General Conditions") and, in particular, the information referred to in art. 52 of the Consumption Code, as provided by Fashion Picture to Customer and posted on the Site, will remain valid and effective until they are modified and / or integrated and will be deemed accepted by the same with the submission of the Purchase Proposal. Any changes and / or additions to the General Terms and Conditions will be effective as of the date on which they will be disclosed to the public and will apply to sales made on that date.
2. PRICES
The sales prices of the products shown on the Site include I.V.A. And any other tax. The delivery costs are indicated on the Site and, in the case of telephone order, repeated to the Customer by the Fashion Picture Operator.
3. PURCHASE AND PAYMENT MODES
3.1 - In the case of a purchase proposal made by telephone or fax, the Contract is intended to be completed when the Customer is notified in the same manner that the proposal is accepted.
3.2 - In the case of a purchase proposal through the Site the Customer will receive a summary email from Milano srl Via Cesare 7, 94012 Barrafranca, informing you that your purchase proposal is being processed and will be deemed accepted , Unless otherwise communicated by e-mail or telephone, after 3 (three) calendar days from the sending of the summary email. Once this term has expired, the Agreement through the Internet is to be understood.
3.3 - Customer will be allowed to choose one of the following methods of payment: (a) by any means of payment from time to time indicated as valid by Milano srl Via Cesare 7, 94012 Barrafranca
4. DELIVERY OF PRODUCTS - CLAIMS
4.1 - Milano srl will process the order within 2 business days and will arrange the shipment of the goods as soon as possible.
4.2 - Any complaint can be filed at the following address: Milano srl Via Cesare 7, 94012 Barrafranca
 5. PRODUCT AVAILABILITY
Milano srl accepts the orders of the Customer within the limits of the quantities of products required in the warehouse. Therefore, Acceptance, by Fashion Image, of the purchase proposal submitted by the Customer is subject to the availability in stock of the products themselves. Fashion Image undertakes to promptly notify the Customer of any unforeseen depletion of stock due to excess demand or other causes.
6. GUARANTEES AND ASSISTANCE
For the products purchased by the Customer, the rules on guarantees and assistance regarding the sale of consumer goods are applicable to Milano srl.
7. CUSTOMER OBLIGATIONS
The Customer declares and warrants:
(I) to be a consumer as provided for in art. 3 of the Consumption Code;
(Ii) be of age;
(Iii) that the data provided by it for the performance of the Contract is correct and true.
8. RIGHT OF WITHDRAWAL
8.1 - The Customer, as provided for by Legislative Decree 6.9.05, No. 206, has the right to terminate the contract without payment of any penalty and without specifying the reason, within 14 days of receipt of the products. The Customer may exercise the right of withdrawal, within the above deadline, by means of a written communication at the headquarters of Milano srl, as per art. 4.2, to be sent by registered letter with acknowledgment of receipt. The communication may also be sent by telegram, telex, e-mail and fax within the same deadline, provided that it is confirmed by registered letter with acknowledgment of receipt within 48 hours.
8.2 - The customer who intends to make use of the right of withdrawal must return the goods in accordance with the instructions that Milano srl will send to you, with the appropriate certificate (PEC), within 14 days of receiving the communication from the Customer to the address indicated by the same In communication. Pursuant to the second paragraph of Article 55 of the Consumption Code, the Customer will not be entitled to withdraw from the following cases: - supply of sealed products opened by the Customer; - the supply of tailor-made or customized products, or which by their very nature can not be returned or is likely to deteriorate or alter rapidly;
8.3 - The customer, subject to the conditions specified above, is entitled to a full refund within 14 calendar days.
9. COMPETENT FORUM
The Contract is governed by Italian law.
Any dispute relating to the application, execution, interpretation and breach of the Contract shall be the responsibility of the forum where the customer has his or her domicile, if located in the territory of the Italian state or of the Enna Forum, if the Client has his or her own Residence or domicile abroad.
